We are well into the legislative session for 2023 and have seen some bills go by the wayside, some have been signed by the Governor, and some are still being discussed.

Below are bills still being discussed I thought WeSERV members would be most interested in knowing about. Further down the page is a list of bills the Governor has already signed.
Active Bills:
HB 2752: Appropriating Monies to the Department of Transportation
Appropriates the sum of $6,500,000 for design and engineering of improvements to SR-85.
SB 1006: Municipal Notices and Ordinances; posting
Modifies noticing requirements for municipalities. Exempts requirement to publish exhibits if the words “exhibits on file at” with a location is on the bottom of the ordinance. Allows cities and towns in counties with populations of 4,000,000 or more to post notices on the city or town’s website. Notices must include a link to notices and ordinances.
SB 1023: Residential Picketing; offense
Person who intentionally pickets outside a person’s residence (not used as a business) could be charged with a class 3 misdemeanor.
SB 1102: Transportation excise tax; Maricopa County
This bill is an extension of Prop 400 transportation funding to levy an excise tax in Maricopa County for transportation needs for the next 20 years beginning in 2026. This bill also prohibits a municipality from providing pocket shelters.
40% of the tax will be allocated to freeways and major arterial streets.
21% of the tax will be allocated to major arterial streets and regional programs including implementation studies.
39% will be allocated to public transportation.
Limits the amount of funds to be used for light rail, provides for regional transportation planning and adds additional Legislative members to the planning group.
SB 1223: Water Infrastructure; commerce grant fund
Provides $8,000,000 to the Water Infrastructure and Commerce Grant Fund. Extends the date for eligible projects and the date for allocation and distribution of funds.
SB 1229: Appropriation; State Route 347
Appropriates $18,000,000 to ADOT for improvements to SR-347 at Casa Blanca Rd and Cement Plant Rd.
SB 1263: Business Personal Property; tax emption
Exempts personal property tax for personal property used in agriculture trade or business.
HB 2063: Appropriation; State Routes 238; 347
Reduces from $19,000,000 to $ 6,000,000 the fiscal year 2023 appropriation for design to widen SR 347 between I-10 and the City of Maricopa.
Appropriates $10,300,000 to ADOT to distribute to the City of Maricopa to design and construct improvements to SR 238 or SR 347 or both.
SB 1184/HB 2067: Municipal Tax Exemption; residential leases
Prohibits TPT tax from being levied on residential rentals beginning January 1, 2024. Provides funds from the general fund be distributed to cities and towns who levied TPT on residential rentals from January 2024 to June 2025.
HB 2107: Appropriation; SR 303; Route 60
Appropriates $4,500,000 to ADOT for improvements to the intersection of SR-303 and U.S.Route 60
HB 2289: Appropriation; State Route 24
Appropriates $18,000,000 to ADOT to distribute to Pinal County for engineering and design costs for
SR 24.
HB 2448: Appropriation; groundwater; Santa Rosa canal
Appropriates $25,000,000 to ADWR to distribute equally between Maricopa-Stanfield Irrigation District and Central Arizona Irrigation District to build water delivery infrastructure.
HB 2449: Appropriation; Pinal East-West Corridor
Appropriates $369,700,000 to ADOT for distribution to Pinal County to design the West Pinal Parkway West Corridor and allocates $360,000,000 to widen I-10 between Chandler and Casa Grande.
HB 2561: City Water Provider; requirements; service
Mandates a municipality providing water service through a stand pipe to less than 750 households in and unincorporated community must be provided water until 2026. Directs a municipality to have an intergovernmental agreement with the county to provide water for not more than 3 years through a standpipe or water hauling. Other limitations are contained in the bill.
HB 2569: Appropriation; Happy Valley Road
Appropriates $12,500,000 to ADOT to distribute to Phoenix for improvements to Happy Valley Road between 35th Ave. and 67th Ave.
HB 2607: Board Members; condominiums; planned communities
If COA or HOA board fails to call a special meeting to remove a board member, then members of the board are automatically removed as of midnight of the 31st day.
SB 1136: Housing grants; military; veteran; homeless
Creates the Housing Grant Program to construct veteran housing made from renewable building materials.
Approved by the Governor:
SB 1049: Homeowner’s Associations; Betsy Ross Flag
Provides that an HOA or COA may not prohibit the display of any historic American Flag including the Betsy Ross Flag.
SB 1168: Real Estate Appraiser; licensure classifications
Permits Az real estate appraisers to appraise 1-4 residential units in a complex with a value if up to $400,000.
SB 1260: Small Business; income tax; rate
Reduces the small business income tax rate to 2.5% beginning December 31, 2022.
HB 2551: Condominiums; insurance coverage; claims
Modifies property insurance requirements for condominium unit owner’s associations.
HB 2301: Homeowner’s Associations; political activity
Allows an HOA or COA that restricts pedestrian or vehicular traffic to prohibit a person from entering if not accompanied by a unit owner or resident.
HB 2381: Mobile Homes; recreational vehicles; fund
Landlord must extend time for repairs to 60 days if tenant present signed contract with a contractor for repairs. Increases amount of funds a tenant forced to relocate due to change of use or redevelopment may receive. Increases amount of moving expenses a tenant force to relocate may receive and other monies.
HB 2438: Board of Supervisors; powers; water
County Boards of Supervisors may participate in water reuse and recycling programs and regional wastewater recharge projects.
HB 2547: Zoning ordinances; property rights, costs
Repeals statute that required a local government legislative body (Council, etc.) to consider cost to construct housing before adopting an ordinance. Requires the local government legislative body to consider a statement of impact of an ordinance including less costly or restrictive alternative methods to further the purpose of the ordinance.
HB 2590: Seller Disclosure; water; solar; batteries
Requires an application for land division to include a signed affidavit acknowledging subdivision laws. Increases to $2,000 civil penalty for each infraction of subdivision land laws by a real estate agent or subdivider. Affidavit of Disclosure provided to buyer must include: name and contact of water hauler and name and location of water supply (if property is currently served by water hauler), disclosure if property has leased or owned battery storage devices and if so contact information for leasing company. Adds other disclosure requirements.
SB 1609: Transitional Housing; DOC; contracts
For one year from effective date the Az Department of Corrections may enter into a contract to provide transitional housing services for inmates. Facility must be state licensed.
