Eviction Moratoria:
Last week on Thursday July 29th, the Biden-Harris Administration released a White House statement. The President called for Congress to extend the moratorium.
Representative Waters introduced a bill that would have extended the moratorium to December 31, 2021 shortly after the White House released the President’s statement.
NAR, the National Association of REALTORS, released a statement on July 29th encouraging Congress and the President to forgo the rental eviction moratorium and instead concentrate on deploying the $50 billion of Emergency Rental Assistance funding.
Consolidated Appropriations Act of 2021
American Rescue Act of 2021
NAR’s simplified statement to Congress was:
“Congress should focus on the effective deployment of nearly $50 billion in federal Emergency Rental Assistance Program (“ERAP”) funds rather than further extending any eviction moratoriums.”
The President also asked federal agencies to extend their moratoria on foreclosure evictions.
HUD, USDA, VA, Fannie Mae and Freddie Mac all announced on July 30th that would be extending their respective foreclosure eviction moratoria on properties foreclosed on by them to September 30, 2021. That eviction moratorium includes any person living in the property, tenant or property owner.
The Treasury Department released two FAQs, on in May and one in June.
An additional $20 million was allocated to HUD so it could develop legal assistance programs for tenants at risk of eviction.
