Surprise Luke AFB Map – You Don’t Have to Carry it Anymore!

I attended the Surprise City Council meeting last night because agenda item #20 was the removal of “Realtor” from Section 26-66 definitions and the removal of Section 26-67(b) from Article III of the Surprise Municipal Code.

For those of us familiar with real estate in the West Valley, Article III contained the provisions requiring “Realtors” to carry a copy of the Luke Air Force noise contour map at all times. Well, that is no longer in code.

The Surprise City Council unanimously voted to remove the sections requiring REALTORS to carry the map. The Council and City Attorney noted that state statute already provides disclosure requirements to buyers by any property seller.

Section 26-67(a) is still in force, sales trailers, model home complexes, brokerage offices, leasing offices, etc. must still display the 24”x36” copy of the Surprise Luke AFB Notification Map at the main public entrance.

I want to thank the WeMAR, now WeSERV West Valley Chapter Luke AFB Task Force for their help in changing this ordinance by presenting to the Council in September 2019 at Call to the Public.
